PROPOSED CHANGES TO PMCD BYLAWS
FEBRUARY 10, 2009

In ARTICLE 1, Section 2 - Add reference to inclusions to the district made since September 26, 1986.
In ARTICLE V, Section 1 - Change “Regular meetings of the board shall be held on the second Wednesday of every month, beginning at the hour of 7:00 p.m. at Hotchkiss Town Hall, Hotchkiss, Colorado, or at the equipment shed, Paonia, Colorado, or at such other hour and place as the Board shall hereafter designate by resolution and proper notice.” to read “Regular meetings of the Board shall be held on a monthly basis from April to October and as needed during the rest of the year at an hour and place designated by the Board by resolution and proper notice.”
In ARTICLE V, Section 1 - Eliminate subsection b.
In ARTICLE VII - Change “ Amendments of these Bylaws shall be adopted by the affirming vote of three-fifths (3/5) of the total membership of the Board at any regular or special meeting of the Board after fourteen (14) days notice in writing has been given to each member of the Board by the Secretary stating therein the proposed amendment.” to read “Amendments of these Bylaws shall be adopted by the affirming vote of four-fifths (4/5) of the total membership of the Board at any regular or special meeting of the Board after the Board has observed the following procedures:  1) Present and discuss proposed changes at a Regular or Special meeting, 2) Make proposed changes available to the electors of the district for review for at least 30 days by placing copies in the local public libraries and making an announcement in the local paper as to their availability, 3) Invite and receive public comment on proposed changes at the next Regular or Special meeting, and 4) Vote on the resolution incorporating revisions (if any) at the following meeting after taking into account comments gathered in the process.
In ARTICLE II, Section 1 - Change “The purposes of this District are to promote the health, safety and general welfare of the inhabitants within the District by providing for the effective control of mosquitoes and similar winged insects threatening disease or nuisance in the area of the District by the means of spraying and such other methods as may be reasonable and practical in the discretion of the Board governing the District.” to read “The purposes of this District are to promote the health, safety, and general welfare of the inhabitants within the District by providing for the safe, effective control of mosquitoes threatening disease or, as resources allow, nuisance in the area of the District by the means of Integrated Pest Management, incorporating a variety of methods as deemed feasible, effective, and practical in the discretion of the Board governing the district.”
